Tomoya Ando (“I,” “me,” or “my”) handles personal information obtained through my work as a freelance photographer, videographer, and editorial writer (collectively, “my services”) in accordance with the policy set out below.

I may collect the following types of information.

(1) Information from clients and inquiries

  • Details of the request and information shared during consultations
  • Billing address and related information (for business or individual clients)

(2) Information obtained through photography and interviews

  • The likeness and appearance of individuals appearing in photos or video
  • Statements, names, affiliations, and background obtained through interviews
  • Personal anecdotes or context shared on location during a shoot

(3) Information collected when you browse my website

  • Cookies, access logs, IP addresses, etc. (when analytics tools are used)

3. Purpose of Use

I use personal information within the scope of the following purposes.

(1) Carrying out my work

  • Responding to inquiries, scheduling, and delivering completed work
  • Invoicing and payment-related administration
  • Communicating with clients and interview subjects

(2) Use by type of work

  • Event photography (public and community events): delivery to organizers, and featuring work in my portfolio or on social media
  • Sports photography: delivery to organizing bodies, athletes, or related parties; provision for press/publicity purposes; portfolio use
  • Food photography: delivery to clients and portfolio use (where people appear in the image, the provisions on subjects in Section 4 apply)
  • Portrait photography: use for the purpose specified by the client, and portfolio/social media use only within the scope agreed to in advance
  • Video (documentary to commercial): production purposes and delivery; any public release or screening only within the scope consented to in advance by participants or interview subjects
  • Editorial writing: drafting articles, turning interview material into published content, and delivery to publications

(3) Use in my own portfolio and promotional materials

  • Featuring work on my website, social media, and promotional materials

(4) Other purposes

  • Contacting you and sending notices as needed

4. Handling of Personal Information of Subjects and Interviewees

Photos, video, and articles may include personal information about the people photographed or interviewed, such as their likeness or statements. I treat the act of photographing and the act of publishing/publicizing photos or video as two distinct matters, and handle each as follows.

(1) Photography For public events, sporting events, community events, and other gatherings held in public settings, I photograph with the organizer’s permission. For photography in settings that are inherently public, I do not require individual consent from every participant.

(2) Publishing and using photos or video When I publish or use photos or video in my portfolio, on my website, or on social media, I handle this according to the nature of the image, as follows:

  • Images where a person appears as part of a crowd, or where individuals are not readily identifiable: may be published without individual consent.
  • Images where a specific individual is clearly identifiable as the main subject (close-ups, portraits, etc.): as a rule, I explain the intended use (where it will appear, the scope of use, duration, etc.) to that person, at the time of the shoot or afterward, and obtain their consent before publishing.
  • Photos or video taken for journalistic or documentary purposes (editorial writing, documentary work, etc.): I weigh the public interest and purpose of the reporting when deciding whether to publish, and where possible, explain the intended use to the interview subject in advance.

In every case, if someone contacts me requesting that an image of them be removed or reconsidered, I will do my best to respond promptly through the contact details below.

  • When a minor is the primary subject of photography, videography, or an interview, and is to be published, I obtain consent from a parent or guardian beforehand.
  • Where it is necessary to provide such information to a third party (delivery to a client, provision to a publication, etc.), I do so only within the purposes explained in advance, and will not provide it beyond that scope.
